Os dados revelam realidade alarmante: conforme o IPEA, 63% das pessoas envolvidas em conflito não aciona o sistema de justiça; a prática de tortura é sistêmica, segundo as Nações Unidas; o sistema carcerário, cuja população aumentou 67% nos últimos 10 anos, é medieval e dá em oferenda nossos jovens (negros em sua maioria) à rede de facções criminosas. A violência contra os segmentos mais vulneráveis (idosos, crianças, negros, mulheres, deficientes, população indígena e LGBT) ecoa na sociedade pelas vozes que incitam o ódio sob o manto de pretensa imunidade.

No cenário de exclusão e violência, é preciso radicalizar a política de ampliação do acesso à justiça. Para tanto, não basta a inclusão no sistema da maioria excluída. Há consenso de que o acesso à justiça não se limita ao direito de acessar o Judiciário. Para que a promoção da justiça seja tarefa de todos, é necessário romper os limites das liturgias forenses e levar a justiça onde o conflito está, ou seja, na vida, na casa e na rua. Nesse sentido, a política de universalização do acesso à justiça deve contemplar dois eixos de atuação: o de proteção dos direitos violados (inclusive quando o órgão violador é o próprio Estado) e o de prevenção da violência, por meio do envolvimento da sociedade na formulação de uma política que assegure direitos e promova a paz.

No primeiro eixo, é preciso coragem para a adoção de políticas públicas no âmbito penal com franco apelo popular: firmeza no combate à tortura e à violência policial, reestruturação da política penitenciária e fortalecimento da defensoria pública para assegurar a proteção dos direitos humanos. Não é aceitável que o Brasil pretenda consolidar sua democracia praticando um direito penal patrimonialista e revanchista que olha para o passado, julga e pune, sob a pretensão de que a privação da liberdade vai “reeducar” o indivíduo a viver em sociedade.

Os estatutos penais devem absorver as práticas restaurativas que recuperam as relações afetadas pela violência. São inúmeras as alternativas penais possíveis que, por sua efetividade, afastam a impunidade: as prestações de serviços comunitários; os círculos restaurativos nos moldes da Resolução n.º 2.002/2012 da Organização das Nações Unidas; a mediação de conflitos no âmbito penal, civil e familiar. No eixo da prevenção da violência, a sociedade pode promover a justiça comunitária antes da judicialização dos conflitos, por meio da mediação, da educação para os direitos e da articulação de uma rede de participação na gestão da comunidade.

A política de acesso à justiça deve mobilizar todos os segmentos sociais contra a violência que emerge no cotidiano, dentro e fora do Estado. Para além das múltiplas portas que o sistema de justiça deve abrir, é necessária a adoção de espaços livres de coerção para a construção de uma justiça acessível, mas, sobretudo, realizada por todos.
